How do I know if I’m eligible for FMLA?

FMLA eligibility depends on three main requirements - you need to meet all of them:

Company size is 5+ (California) or 50+ (Federal)

Your employer must have 5+ employees for CFRA coverage or 50+ employees within 75 miles of your worksite for federal FMLA coverage

Employer >1 Year

You must have worked there for at least 12 months (doesn't have to be consecutive)

1250+ Hours worked

You need 1,250 hours in the past 12 months (about 24 hours per week)

Qualifying condition

You must have one of the qualifying conditions we covered above, or be caring for a qualifying family member with a serious health condition
