Understanding your FMLA leave rightsEmployee considering FMLA leave options

What is FMLA, and is it right for you?

What is FMLA?
  • A federal program that allows for up to 12 weeks of job protected leave.
  • It can be used for your own serious health condition or to support a family member.
  • Your employer must hold your job (or an equivalent role)
  • Your health benefits continue during leave
What it does NOT do
  • It does not provide wage protection.
When FMLA makes sense
  • You need time off to recover or support a family member in need
  • You’re worried about job security
  • You can’t realistically work while managing the issue

How Do I Know I am Eligible for FMLA?

Qualifying for FMLA depends on three main requirements - You need to meet all four to qualify.
01

Your company has at least 50 employees.

Your employer must have 50+ employees within 75 miles of your worksite.
02

You have worked for the company for at least 1 year.

You must have worked there for at least 12 months (this time doesn't have to be consecutive).
03

You have worked at least 1250 total hours at the company.

You must have worked at least 1250 in the last 12 months. This is about 24 hours per week.
04

You have a qualifying condtion.

FMLA covers four broad qualifying conditions.
Your own serious health condition.
Care for a loved one.
Childbirth, adoption, or bonding.
Qualifying exigency, or military caregiver leave.
For more information on what qualifies as a serious health condition, read our deep dive here.

What Conditions Qualify For FMLA?

Not every situation qualifies for FMLA protection. The law generally covers 3 broad buckets.
Your own or a family member’s serious health condition
A serious health condition is an illness or injury that requires an overnight hospital stay, ongoing treatment, or regular care for a chronic condition. Take our quick quiz to see if you’re likely to qualify for FMLA.
Childbirth, adoption or bonding.
You’re eligible for time off after childbirth or to bond with a newly adopted or foster child. The leave must be taken within 12 months of the birth or placement.
Qualifying exigency or military caregiver leave
You can take up to 26 weeks to care for a service member with a serious injury or illness. You may also qualify if you need to handle urgent matters while your spouse, child, or parent is on active duty—like childcare, military events, or managing finances.

What Counts as a Serious Health Condition

Serious health condition has very specific definitions, but many situations qualify.
01
Chronic condition requiring two or more visits per year with a health care provider
02
Staying overnight in the hospital
03
Permanent, long term conditions (Alzheimer's, neurological issue, etc)
04
3+ days of missing work followed by a period of treatment or a second visit to a healthcare provider.
05
Conditions requiring multiple treatments (dialysis, chemotherapy, etc)
Patient with a qualifying serious health condition for FMLA
Common FMLA conditions:
This list is not exhaustive. If you feel like you need time off, consider applying for FMLA.
Depression
Anxiety
Chronic Pain
Post Partum
Cancer Treatment
Hormonal Issues
Injury
Diabetes
Migraines
Pregnancy
Kidney Disease
Menstrual Issues

How Do I Start Taking FMLA?

It's a 3-party process: you, your employer, and your doctor. Here's exactly who does what.

You Tell Your Employer You Need Leave

A simple notice: "I need medical leave starting [date]." This can be verbal. Give 30 days notice when possible. If you're already on leave, notify ASAP.

Your Employer Responds Within 5 Business Days

They confirm your eligibility, provide the certification forms, and set your deadline (typically 15 days to return completed forms).

We Complete Your Evaluation and Forms in 1-2 Days

You book an appointment with our doctors. We evaluate your condition and complete all required forms.

You Submit Your Completed Forms to HR

Your employer reviews your forms and determines whether you're approved for leave.

Your Leave Begins

If approved, your leave starts on the first day you miss work. Benefits continue and your job is protected.

How Much Time Can I Take Off?

You get 12 weeks of leave in a 12-month period, but you don't have to take it all at once. Military caregiver leave is different - you can take up to 26 weeks to care for a covered service member with serious injury or illness. Here are your options for taking time off:
FMLA provides up to 12 weeks of job-protected leave per year
01.
Intermittent Leave
Allows you to take time off in seperate blocks as needed for up to 60 days per year. This could be helpful if you have recurring appointments and/or treatment.
Example: Taking Fridays off to receive chemotherapy treatment or care for a loved one.
02.
Continuous Leave
Allows you to take up to 12 weeks per year of uninterrupted leave for a qualifying condition without the fear of job loss. This could be helpful when you need consecutive days off for a larger block of time.
Example: Taking 8 weeks off for a medical procedure.
03.
Reduced Schedule
Allows you work fewer hours than your regular daily or weekly schedule to provide flexibility to manage a qualifying health condition, while still fulfilling partial work responsabilities.
Example: Instead of your regular scheduled 40 hours per week, you work 20 hours to care for a loved one.

FAQ

What factors affect FMLA or paid leave approval?

FMLA approval depends on a few key factors:

1. Employment eligibility
You must have worked for your employer long enough and be working for an employer that is covered under FMLA. Employers with more than 50 employees are covered under FMLA.

2. A qualifying medical condition
Your leave must be for a condition that qualifies under FMLA. A licensed healthcare provider must evaluate your situation and certify that you meet one of these qualifying conditions.

If both of these criteria are met, your employer is required to grant FMLA leave. The employer’s role is to review the certification for completeness and administer the leave, not to change the requirements.

Paid leave approval is dependent on your state specific rules and requirements. .

What conditions qualify for FMLA, Paid Leave, or Disability Certification?

Most physical and mental health conditions qualify for at least one type of leave protection. The same condition often   qualifies for multiple programs simultaneously — FMLA for job protection, state paid leave for income replacement,     and disability for extended coverage. Here's how each works.

Conditions That Qualify for FMLA

- Birth and care of a newborn child.
- Adoption or foster care placement of a child.
- Care for a spouse, child, or parent with a serious health condition.
- The employee’s own serious health condition that prevents them from attending work.

Conditions That Qualify for State Paid Leave

Thirteen states plus DC currently have paid family and medical leave programs: California, New Jersey, Rhode Island,    New York, Washington, Massachusetts, Connecticut, Oregon, Colorado, DC, Delaware, Minnesota, and Maine. Maryland  launches in 2028. Each state has its own forms and requirements, but the qualifying conditions are broadly similar: your own serious health condition, caring for a family member, bonding with a new child, or pregnancy-related needs.

Conditions That Qualify for Disability Certification
Short-term disability (STD) and state disability insurance (SDI) cover conditions that prevent you from working,        including:

- Pregnancy and childbirth recovery (4-6 weeks vaginal delivery, 6-8 weeks C-section)
- Surgery recovery
- Severe injuries
- Mental health conditions including depression, anxiety, and PTSD
- Chronic condition flares (migraines, fibromyalgia, lupus)
- Cancer treatment

Five states have mandatory disability programs (California, New York, New Jersey, Rhode Island, Hawaii), while many employers offer private short-term disability insurance. Disability benefits typically replace 50-90% of your wages  for up to 26-52 weeks depending on the program.

Can I get FMLA, Paid Leave, or Disability for mental health?

Yes. Anxiety, depression, PTSD, and other mental health conditions qualify if they meet the "serious health condition" criteria—meaning you need continuing treatment from a healthcare provider. This includes conditions requiring medication, regular therapy, or that prevent you from working for 3+ days.

Take our pre-qualification quiz to see if your mental health condition qualifies for FMLA and Paid Leave.
Can you help if my FMLA or Paid leave needs to start retroactively (in the past)?

If you’re requesting an FMLA or paid leave certification with a start date further in the past, we’ll need existing medical documentation that shows you were evaluated or treated during that earlier period. This is required to ensure the certification is accurate and compliant.

How quickly will I get my completed FMLA or Paid Leave forms?

We complete FMLA or Paid Leave forms within 24 hours of your consultation with the healthcare provider.

Can the healthcare provider help me if I don't have a diagnosis yet?

You don’t need a formal diagnosis to qualify for FMLA or Paid Leave. The healthcare provider will focus on understanding what you’re going through and whether your situation qualifies for protected leave. While they don’t diagnose or treat, they can help certify your leave and guide you toward appropriate next steps so you can take time off and focus on feeling better.

What medical certification services do you offer?

We offer the following services:

- Intermittent FMLA Certification
- Continuous FMLA Certification
- Reduced Schedule FMLA Certification
- Return to Work Forms
- Paid Leave Forms
- Employer Short Term Disability
- State Disability
- ADA

Each service requires a 10-minute video consultation with one of our board-certified healthcare providers.

Receive your paperwork: Your completed certification paperwork will be provided to you within 24 hours of the video visit.

How do I book an appointment?

To book an appointment, simply visit our website, complete the intake, pay a $50 deposit to reserve your spot, and schedule your 10-minute video consultation with one of our Board-Certified healthcare providers. What sets Trust Medical apart?

People trust us. We recognize the importance of your job and your academic standing, which is why we adhere to the highest standards of integrity and ensure we're fully compliant.

Additionally, we know this process can be anxiety inducing, which is why we take pride on our customer support and we make it extremely easy to speak to us and help you get your issues resolved.

We believe so much in what we do that we offer an 100% money back guarantee.

All of our healthcare provider credentials are public and easily verifiable. Additionally, all of our certifications & evaluations are completed to the highest standard and contain all the details your employer needs to feel confident.

We set the standard for FMLA certifications.

What if I need to extend my leave and take additional time off?

We have follow up appointments available if you need to extend your leave.

Follow-up video appointments are available for $75.00. A follow-up may be recommended if you need additional time off to make progress in your recovery. During a follow-up, the healthcare provider reassesses your situation and, if appropriate, can update or extend your certification.

How much time can I take off with FMLA?

Up to 12 weeks in a 12-month period for most qualifying reasons. Military caregivers can take up to 26 weeks. You can take it all at once, or intermittently (a few days/hours at a time) for chronic conditions. The 12 weeks resets based on your employer's chosen method (calendar year, your anniversary, etc.).

Do I need to pay for the entire service up front?

There is an initial $50 booking fee to secure your appointment. The remaining balance will be charged after your video consultation.

Do you accept insurance?

No, our services are self-pay only. We do not bill insurance providers, and all payments are made out of pocket. We strive to keep our prices transparent and affordable.

Do you get paid for FMLA?

No, FMLA itself is unpaid. However, you can use accrued PTO, sick leave, or vacation days during FMLA. Some states (California, New York, New Jersey, Rhode Island, Washington) have separate paid family leave programs. You might also qualify for short-term disability benefits through your employer. Trust Medical can help you with certification for paid leave or disability.
