Standard federal FMLA requires your employer to have 50+ employees within 75 miles, 12+ months of tenure, and 1,250+ hours worked in the past year.
If you've earned enough wages to meet the Department of Unemployment Assistance financial eligibility threshold (tied to minimum earnings in your base period), you likely qualify for PFML. Most W-2 employees and some 1099 workers are covered.
If you qualify for both, they run at the same time — FMLA protects your job while PFML pays your wages. You don't get to stack the durations, but you get both protections during the same leave period.
Unlike California or Colorado, Massachusetts does not offer a voluntary opt-in for self-employed workers. If you're a freelancer or independent contractor, you may not be eligible for PFML unless you have qualifying W-2 earnings.
