Why Colorado's Leave Protections Are Among the Best in the Country

Colorado's FAMLI program launched in 2024 and is already one of the most generous paid leave programs in the nation. Here's what you get:

Get paid up to 90% of your wages — FAMLI pays up to 90% of your wages (max $1,381.45/week) for up to 12 weeks. Federal FMLA is completely unpaid. FAMLI covers your own health condition, family care, bonding, and military exigency.

Nearly everyone qualifies — FAMLI covers almost all Colorado workers, regardless of employer size, as long as you've earned $2,500 or more. No 12-month tenure requirement. No 1,250-hour minimum. Even employees of companies with just 1 worker can qualify.

The most generous pregnancy and NICU protections in the country — Standard FAMLI gives you 12 weeks. Pregnancy complications add 4 more weeks (16 total). If your baby is in the NICU, you get up to 12 additional weeks (24 total). No other state matches this.

How Do I Know If I'm Eligible?

Colorado has two leave programs with different eligibility rules:

Federal FMLA: 50+ employees, 12 months, 1,250 hours

Standard federal FMLA requires your employer to have 50+ employees within 75 miles, you've worked there 12+ months, and you've logged 1,250+ hours in the past year.

Colorado FAMLI: Earned $2,500+ in wages — that's it.

FAMLI has a much lower bar than FMLA. If you've earned $2,500 or more in Colorado wages, you likely qualify — regardless of employer size, how long you've worked there, or how many hours per week.

Both at the same time

If you qualify for both, FMLA protects your job while FAMLI pays your wages. They run at the same time — you don't get to stack the durations. But you get both protections during the same leave period.

What Colorado doesn't have

Colorado does not have a separate state disability insurance program like California's SDI. For longer-term medical conditions beyond FAMLI's 12 weeks, check if your employer offers short-term disability insurance, or explore ADA accommodations.

FAMLI pays up to 90% of your wages

FAMLI replaces up to 90% of your wages (calculated as 90% up to 50% of the state average weekly wage, plus 50% of wages above that). Maximum weekly benefit: $1,381.45 in 2026. Funded through a shared 0.88% payroll contribution.

More family members covered

FAMLI lets you take leave to care for your spouse, domestic partner, child, parent, parent-in-law, sibling, grandparent, or grandchild. Federal FMLA only covers spouse, child, and parent.

Up to 24 weeks for pregnancy and NICU

Standard FAMLI: 12 weeks. Pregnancy complications: +4 weeks (16 total). NICU stays: +12 weeks (up to 24 total). These are the most generous pregnancy and NICU provisions in the entire country.

$2,500 earned — no other requirements

FAMLI doesn't require 12 months of employment or 1,250 hours worked like federal FMLA. If you've earned $2,500 or more in wages, you meet the threshold. Part-time and seasonal workers often qualify.
