Why Oregon's Paid Leave Is One of the Most Generous in the Country

Losing income while you're sick is scary — especially if you're already on a tight budget. Oregon's program launched in 2023 and stands out for one key reason: if you earn a lower wage, you get 100% of your pay replaced. Higher earners still see a solid benefit. Here's what the program provides:

100% wage replacement for lower earners

Oregon Paid Leave replaces 100% of your wages up to 65% of the state average weekly wage, plus 50% of wages above that. If you earn below the threshold, every dollar is replaced. Maximum benefit: $1,636.56/week — second only to California in the entire country.

Up to 14 weeks for pregnancy

Standard Paid Leave provides 12 weeks per year. If you experience pregnancy-related complications, you qualify for 2 additional weeks (14 total). Use it for your own medical condition, family care, bonding, or safe leave (domestic violence, harassment, stalking).

Small employer? You're still covered

Oregon Paid Leave covers all workers regardless of employer size. Employers with fewer than 25 employees are exempt from paying the employer share of contributions, but their workers still qualify for benefits. Funded through a shared 1% payroll contribution (60% employee, 40% employer).

How Do I Know If I'm Eligible?

Oregon has two overlapping leave programs. You may qualify for one or both:

Federal FMLA: 50+ employees, 12 months, 1,250 hours

Standard federal FMLA requires your employer to have 50+ employees within 75 miles, 12+ months tenure, and 1,250+ hours worked in the past year.

Oregon Paid Leave: Earnings-based

If you've earned $1,000+ in wages during the base year and made contributions to the program, you likely qualify. No employer size minimum for worker eligibility. No long tenure requirement.

FMLA + Paid Leave run concurrently

If you qualify for both, FMLA protects your job while Paid Leave pays your wages. They run at the same time. You get both protections during the same leave period.

Self-employed: Voluntary opt-in available

Freelancers and independent contractors can opt into Oregon Paid Leave. Given the 100% replacement rate for lower earners and the $1,636.56/week maximum, Oregon's program is one of the most valuable opt-in options available to self-employed workers.

Every Oregon worker who meets the earnings threshold qualifies for Paid Leave benefits — even if your employer has just 1 employee. Employers with fewer than 25 workers are exempt from the employer contribution share, but their employees still receive full benefits.

Shared funding: 1% payroll contribution

Oregon Paid Leave is funded through a 1% payroll contribution split 60/40 between employees and employers. For employers with fewer than 25 employees, the full 1% comes from employee contributions. You're paying into this benefit — make sure you use it when you need it.

Safe leave included

Oregon is one of the few states that includes “safe leave” in its paid leave program. If you or a family member is dealing with domestic violence, harassment, sexual assault, or stalking, you may qualify for up to 12 weeks of paid leave to address safety needs.
