Why Washington Has Some of the Strongest Leave Protections in the Country

Washington's Paid Family & Medical Leave program gives most workers access to paid time off for medical conditions, family care, and bonding. Here's what makes it stand out:

Get paid up to 90% of your wages — Washington PFML pays up to 90% of your wages (max $1,647/week) — the third-highest benefit in the country behind California and Oregon. Federal FMLA alone is completely unpaid.

Up to 18 weeks of combined leave — Washington offers up to 18 weeks of combined medical and family leave through PFML. That's 6 weeks more than the 12 weeks federal FMLA provides. You can split it between your own medical condition and family care.

Expanding job protection in 2026 — Starting January 2026, employers with 25+ employees must guarantee your job when you return from PFML leave. This expands to 15+ employees in 2027 and 8+ in 2028. Previously, only employers with 50+ had to hold your position.

How Do I Know If I'm Eligible?

Washington has two leave systems. You may qualify for one or both:

Federal FMLA: 50+ employees, 12 months, 1,250 hours

Standard federal FMLA requires your employer to have 50+ employees within 75 miles, you've worked there 12+ months, and you've logged 1,250+ hours in the past year.

WA PFML: 820+ hours worked — most workers qualify

If you've worked 820+ hours in the qualifying period, you're likely eligible for PFML wage replacement regardless of employer size. That's roughly 16 hours per week for a year. No tenure requirement.

New: Job protection for employers with 25+ employees

As of January 2026, employers with 25+ employees must restore your job after PFML leave. This threshold drops to 15+ in 2027 and 8+ in 2028. If your employer is smaller, you still get wage replacement — but job protection depends on whether you also qualify for federal FMLA.

No state disability insurance

Washington does not have a separate disability program like California's SDI. Medical leave and family leave share the same 18-week PFML pool. Self-employed and gig workers are generally not covered (unlike California and Colorado, which offer opt-in).

Washington PFML replaces up to 90% of your wages, calculated as 90% up to 50% of the state average weekly wage plus 50% of wages above that. Maximum benefit: $1,647/week in 2026. Funded through a shared 1.13% payroll contribution.

Up to 18 weeks of combined leave

Washington offers up to 18 weeks of combined medical and family leave — 6 weeks more than federal FMLA's 12. You can use the full 18 weeks for medical reasons, family care, or a combination. After FMLA's 12-week job protection ends, PFML may continue paying for the remaining weeks.

2026: Job protection now covers more workers

Starting January 2026, employers with 25+ employees must hold your job during PFML leave. This threshold drops to 15+ in 2027 and 8+ in 2028. If your employer has 50+, you already have job protection through federal FMLA.

More family members covered

Washington PFML lets you take leave for your spouse, domestic partner, child, parent, parent-in-law, grandparent, grandchild, or sibling. Federal FMLA only covers spouse, child, and parent.

820 hours worked — no employer size minimum

PFML requires just 820 hours worked in the qualifying period for wage replacement. No 12-month employment requirement. No employer size threshold. Part-time workers and newer employees often qualify when they wouldn't under FMLA.
