Why Get FMLA Leave In Washington?

Washington offers some of the strongest family and medical leave protections in the country. If you live or work in WA, you may qualify for both federal FMLA and the state’s Paid Family & Medical Leave (PFML) program.

You may receive paid time off through Washington PFML. The program pays up to 90% of your weekly wages for up to 12 weeks when you have a qualifying medical condition or need family-care leave. Federal FMLA is unpaid, but Washington’s PFML program provides wage replacement.

Washington PFML also allows more covered reasons for leave, including bonding with a new child, caring for a seriously ill family member, military-related events, recovering from your own health condition, and more. Washington PFML covers a wider range of family members compared to federal FMLA. In addition to spouse, child, and parent, PFML also covers grandparents, grandchildren, siblings, and in-laws.

Washington PFML offers longer potential leave. Employees may receive up to 16 weeks of combined medical and family leave in a benefit year, or up to 18 weeks for pregnancy-related complications—significantly more than the standard 12 weeks under federal FMLA.

How do I know if I’m eligible for FMLA?

FMLA eligibility depends on four main requirements - you need to meet all of them:

Company size is 50+

Your employer must have 50+ employees within 75 miles of your worksite for federal FMLA coverage

Employer >1 Year

You must have worked there for at least 12 months (doesn't have to be consecutive)

1250+ Hours worked

You need 1,250 hours in the past 12 months (about 24 hours per week)

Qualifying condition

You must have one of the qualifying conditions we covered above, or be caring for a qualifying family member with a serious health condition
