Standard federal FMLA requires your employer to have 50+ employees within 75 miles, 12+ months tenure, and 1,250+ hours worked in the past year.
Delaware PFML generally applies to employers with 10 or more employees. If your employer has fewer than 10 workers, they may be exempt. Parental leave has broader coverage requirements than medical and family leave. Check your employer's participation status.
If you qualify for both programs, they run at the same time. FMLA provides 12 weeks of job protection while PFML provides wage replacement. For medical leave, PFML pays for 6 weeks while FMLA protects your job for 12 — giving you options for the remaining 6 weeks.
Since Delaware PFML is brand new, confirm that your employer is participating and making contributions. Employers with fewer than 10 employees may be exempt. Your HR department should be able to confirm your coverage status.
