Maine's Paid Leave Program Is Almost Here

Maine's PFML program launches in May 2026 — just weeks away. If you work in Maine and have been paying into the program through payroll deductions, help is almost here. Here's what to expect:

12 weeks of paid leave

Maine PFML will provide up to 12 weeks of paid leave per benefit year. Use it for your own serious health condition, to care for a seriously ill family member, to bond with a new child, or for other qualifying reasons. That matches federal FMLA's duration — but with actual wage replacement.

Up to 90% wage replacement for lower earners

Maine's formula: 90% of wages up to 50% of the state average weekly wage, plus 66% of wages above that. Maximum benefit: $1,144.67/week. If you earn below the median, you'll see close to 90% of your income replaced. Higher earners still get a decent benefit.

You may already be paying in

Maine PFML is funded through a shared 1% payroll contribution split 50/50 between employees and employers. Employers with fewer than 15 employees don't pay the employer share, but their workers still contribute and qualify. If you see PFML deductions on your pay stub, benefits will be available to you starting May 2026.

How Do I Know If I'm Eligible?

Maine PFML launches May 2026. Here's how eligibility will work alongside federal FMLA:

Federal FMLA: 50+ employees, 12 months, 1,250 hours

Standard federal FMLA requires your employer to have 50+ employees within 75 miles, 12+ months tenure, and 1,250+ hours worked in the past year. This is available now.

ME PFML: Launching May 2026

If you've been contributing to Maine PFML through payroll deductions, you should be eligible once the program launches. The program will cover most workers, including those at small employers. Funded through a 1% payroll contribution split 50/50.

Small employer participation

Employers with fewer than 15 employees are exempt from paying the employer share of PFML contributions. However, their employees still contribute and still qualify for benefits. Even small-company workers will have access to paid leave.

Prepare now, file when it launches

If you anticipate needing leave around May 2026 or later, get your FMLA certification now and be ready to file for PFML benefits as soon as the program opens. Having your medical documentation prepared ahead of time means faster benefits.

How Trust Medical Ensures Your Forms Are Maine-Compliant

Maine's PFML program is launching in May 2026, which means the documentation requirements and filing processes are brand new. Early filers face the highest risk of delays from incomplete or incorrect paperwork.

Our Maine-licensed physicians complete your FMLA certification and will provide the medical documentation needed for your PFML application once the program launches. We're preparing for Maine's specific requirements so your claims are processed correctly from day one.

In most cases, your employer cannot require you to use PTO while you're receiving PFML benefits. We help you understand your rights under both federal law and Maine's new paid leave program.

Maine Leave Laws & Your Rights Explained

12 weeks of paid leave starting May 2026

Maine PFML provides up to 12 weeks of paid leave per benefit year. This matches FMLA's duration but adds wage replacement. The program covers your own medical condition, family care, bonding, and other qualifying reasons.

Up to 90% replacement for lower earners

The wage formula pays 90% on income up to 50% of the state average weekly wage, plus 66% on income above that. Maximum: $1,144.67/week. This progressive formula ensures workers who can least afford lost income get the highest percentage replaced.

Shared funding: 1% payroll contribution

Maine PFML is funded through a 1% payroll contribution, split 50/50 between employees and employers. Employers with fewer than 15 employees don't pay the employer share. Contributions have already started — benefits begin May 2026.

Small employers: Workers still covered

Even if your employer has fewer than 15 employees and is exempt from the employer contribution, you as a worker still contribute to and qualify for PFML benefits. The program is designed to cover Maine workers at companies of all sizes.

Newest program in the country

Maine will be the 13th state (plus DC) to offer paid family and medical leave when the program launches. As the newest program, documentation requirements may evolve. Our physicians stay current on the latest standards.
