Standard federal FMLA requires your employer to have 50+ employees within 75 miles, 12+ months tenure, and 1,250+ hours worked in the past year.
You may qualify if you worked at least 20 weeks earning $310+ per week, or earned $15,500+ total in the base year. Benefits are funded through shared employee and employer contributions.
Starting July 2026, eligibility drops to just 3 months of employment and 250 hours worked. Employers with 15+ employees will be covered (down from 30). Many more part-time and newer workers will qualify.
Freelancers and independent contractors can voluntarily opt into New Jersey's disability and family leave programs. The 85% replacement rate makes NJ one of the most valuable opt-in programs available.
New Jersey's leave system involves three overlapping programs — federal FMLA, state FLI, and TDB — each with different forms and different administering agencies. The state programs run through the Division of Temporary Disability Insurance, while FMLA goes through your employer.

New Jersey TDB has no waiting period. Benefits can begin from the first day you're unable to work. California, New York, and Hawaii all require 7-day waiting periods. This matters when you're already dealing with lost income from a health condition.
TDB provides up to 26 weeks of disability benefits at 85% of wages. For longer-term conditions, that's 6 months of real income replacement — not the $170/week cap you'd get in New York.
