Why New York Has Three Layers of Leave Protection

New York is one of only four states with both paid family leave AND state disability insurance. That sounds great on paper. But the details matter — especially around disability. Here's what you actually get:

PFL pays 67% of your wages for 12 weeks

New York Paid Family Leave replaces 67% of your average weekly wage, up to $1,228.53 per week, for up to 12 weeks. Use it for bonding with a new child, caring for a seriously ill family member, or qualifying military exigency. Funded entirely through employee payroll deductions (0.432% of wages). Federal FMLA alone is completely unpaid.

Disability benefits exist — but the cap is shockingly low

New York's Disability Benefits Law covers your own medical condition for up to 26 weeks. The problem: it pays only 50% of your wages, capped at $170 per week. That's not a typo. Most employers supplement DBL with private short-term disability insurance. If yours doesn't, you may be looking at $170/week maximum. Job protection through FMLA and PFL

Federal FMLA protects your job for 12 weeks at employers with 50+ employees. New York PFL provides separate job protection at employers with just 1 or more employees for family-related leave. Your DBL disability leave does not automatically include job protection — which is why filing for FMLA concurrently matters.

How Do I Know If I'm Eligible?

New York has three separate programs with different rules. You may qualify for more than one:

Federal FMLA: 50+ employees, 12 months, 1,250 hours

Standard federal FMLA requires your employer to have 50+ employees within 75 miles, you've worked there 12+ months, and you've logged 1,250+ hours in the past year.

New York PFL: Almost all employees covered

PFL covers employees who have worked 26+ consecutive weeks (full-time) or 175+ days (part-time). There is no employer size minimum — even companies with 1 employee must provide PFL coverage.

Disability (DBL): Broad eligibility, low benefit

DBL covers most private-sector employees after 4 consecutive weeks of employment. The benefit is 50% of wages, capped at $170/week, with a 7-day waiting period. You cannot collect PFL and DBL at the same time.

Self-employed: Voluntary opt-in available

If you're a freelancer or independent contractor, you can voluntarily opt into New York PFL coverage. This is unusual — most states don't offer self-employed access to paid family leave.

DBL: 26 weeks, but only $170/week max

New York's disability benefit covers your own medical condition for up to 26 weeks with a 7-day waiting period. But the maximum is just $170/week — far below what most workers need. Most employers purchase private short-term disability to supplement this. Ask your HR department what additional coverage you have.

PFL covers employers of any size

Unlike federal FMLA (50+ employees), New York PFL applies to every employer with even 1 employee. If you work in New York, you almost certainly have access to paid family leave — even if your company is too small for FMLA.

You cannot collect PFL and DBL simultaneously

New York does not allow you to receive PFL and DBL benefits at the same time. If you have your own medical condition AND a family care need, you may need to sequence your benefits. We help you plan the order that gives you the most protection.

Broader family coverage under PFL

New York PFL covers care for your spouse, domestic partner, child, parent, parent-in-law, grandparent, grandchild, or sibling. Federal FMLA only covers spouse, child, and parent.
