DC's UPLA provides up to 12 weeks for your own medical condition, 12 weeks for family leave, and 12 weeks for parental leave — each tracked separately. Plus 2 weeks of prenatal leave for pregnancy. If you have multiple qualifying needs, you may access more total paid leave than in most states.

DC UPLA pays a variable replacement rate based on your income, with a maximum weekly benefit of $1,190. The program is funded entirely by employer contributions — DC is one of the few jurisdictions where workers don't pay into the program through payroll deductions.

How Do I Know If I'm Eligible?

DC has its own paid leave program alongside federal FMLA. Here's how they work together:

Federal FMLA: 50+ employees, 12 months, 1,250 hours

Standard federal FMLA requires your employer to have 50+ employees within 75 miles, 12+ months tenure, and 1,250+ hours worked in the past year.

DC UPLA: Work in DC for a covered employer

If you work for a DC employer who pays into the Universal Paid Leave fund, you're likely eligible. Most private-sector DC employers are covered. Eligibility is tied to working in DC — not where you live. Maryland and Virginia residents who work in DC may qualify.

FMLA + UPLA run concurrently

If you qualify for both, FMLA protects your job while UPLA pays your wages. They run at the same time. FMLA provides 12 weeks of job protection; UPLA provides wage replacement for the same period (or longer, depending on leave type).

Live outside DC but work there? You may still qualify.

DC UPLA eligibility is based on where you work, not where you live. If your employer is based in DC and contributes to the paid leave fund, you may be eligible for benefits even if you commute from Maryland or Virginia.
